1. Our Services

Inception System provides eCommerce and web development services, including custom store development, platform migrations, plugin/extension development, integrations, and ongoing support, across Shopify, WooCommerce, OpenCart, and custom web platforms. The specific scope, deliverables, timeline, and cost of any project will be defined separately in a written proposal, quote, or agreement between Inception System and the client before work begins.

2. Project Terms

Quotes are estimates based on the requirements shared at the time of inquiry, and final scope, pricing, and payment terms are confirmed in the project proposal or invoice. Delivery timelines are estimates and may vary based on project complexity, client responsiveness, and third-party dependencies (e.g., app store approvals, hosting provider delays).

3. Client Responsibilities

To ensure timely and accurate delivery, clients are expected to:

  • Provide complete and accurate project requirements
  • Supply necessary content, assets, brand guidelines, and access credentials in a timely manner
  • Respond to review requests and feedback within a reasonable time
  • Ensure they have the legal right to use any content, images, trademarks, or materials they provide us for use on their store or website

4. Intellectual Property

  • Upon full payment for a completed project, ownership of the final custom-developed deliverables (excluding third-party platforms, themes, plugins, or licensed assets) transfers to the client.
  • Any third-party software, themes, plugins, or platforms (such as Shopify, WooCommerce, or OpenCart itself, and any licensed extensions) remain subject to their own respective licenses and are not owned by Inception System or transferred as our intellectual property.
  • Inception System retains the right to showcase completed projects in our portfolio, case studies, and marketing materials, unless otherwise agreed in writing with the client.

5. Third-Party Platforms and Services

Our services often involve building on or integrating with third-party platforms (Shopify, WooCommerce, OpenCart, payment gateways, hosting providers, marketing tools, etc.). We are not responsible for outages, policy changes, pricing changes, or feature limitations imposed by these third parties, as they are outside our control.

6. Warranties and Limitations

  • We strive to deliver high-quality, functional, and secure solutions. Where applicable, we offer a limited post-launch support/bug-fix window as outlined in the project proposal.
  • We do not guarantee specific business outcomes (such as sales, traffic, or search engine rankings) resulting from our services, as these depend on factors outside our control.
  • To the extent permitted by law, Inception System’s liability for any claim arising from our services is limited to the amount paid by the client for the specific project in question.

7. Website Use

By using our website, you agree not to:

  • Use it for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or data
  • Copy, reproduce, or distribute our website content without permission
  • Interfere with the security or proper functioning of our website

8. Termination

Either party may terminate an ongoing project agreement as outlined in the specific project proposal or contract. In the absence of a specific agreement, either party may terminate services with reasonable written notice, with payment due for work completed up to the termination date.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or for legal and operational reasons. The revised Terms will be posted on this page with an updated “Last Updated” date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
